CyNtelligent Solutions, LLC ("CyNtell," "we," "us," or "our") respects your privacy and is committed to protecting it through this Privacy Policy. This policy describes the types of information we may collect from you or that you may provide when you visit cyntell.com (the "Site"), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

By using the Site, you agree to this Privacy Policy. If you do not agree with our policies and practices, please do not use the Site. This policy may change from time to time (see Changes to This Policy). Your continued use of the Site after we make changes is deemed acceptance of those changes.

Scope of This Policy

This policy applies to information we collect on the Site; through email, text, and other electronic messages between you and CyNtell; and when you interact with our advertising on third-party websites and services, if that advertising links to this policy.

This policy does not apply to information CyNtell collects, processes, or stores on behalf of its clients while performing services under a client engagement, such as data encountered during a gap assessment, penetration test, or managed monitoring engagement. That information is governed by the applicable client contract, statement of work, and any data processing terms agreed with that client. This policy also does not apply to information collected by any third-party site that may be linked to or from our Site (see Third-Party Links).

Information We Collect

The table below summarizes the categories of personal information we have collected in the preceding 12 months, in the format commonly used for state privacy law disclosures, such as those required under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

  • Directly from you, when you fill out a form, request a consultation, call us, email us, subscribe to our emails, or apply for a job.
  • Automatically, through cookies, web beacons, and similar technologies when you browse the Site.
  • From third parties, such as analytics and advertising partners (see Cookies and Tracking Technologies), or occasionally from a colleague or employer who refers you to us.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Respond to your inquiries, schedule consultations, and provide the services you request;
  • Present our Site and its content to you, and measure and improve its performance;
  • Communicate with you about our services, including responding to your comments, questions, and requests;
  • Send newsletters and marketing emails about our services, which you can unsubscribe from at any time by using the link in any email or by contacting us;
  • Carry out our obligations arising from any contracts entered into between you and us;
  • Evaluate job applications, if you apply for a position with us;
  • Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity;
  • Notify you about changes to our Site or any services we offer; and
  • Fulfill any other purpose with your consent.

Cookies and Tracking Technologies

Our Site uses cookies and similar tracking technologies to distinguish you from other users, personalize content, and understand how visitors use the Site. You can set your browser to refuse all or some cookies, but if you do, some parts of the Site may not function properly.

We use Google Ads, including remarketing, to advertise our services to people who have previously visited our Site, and Google Analytics to understand how the Site is used. These services use cookies to serve ads based on past visits to our Site. You can opt out of Google's use of cookies for interest-based advertising through Google's My Ad Center, and learn how Google collects and processes data at Google's Privacy and Terms page. You can also opt out of interest-based advertising from many companies at once through the Digital Advertising Alliance's opt-out tool.

Our contact forms are provided by HubSpot, which may set cookies to process submissions and associate them with your inquiry. You can learn more in HubSpot's Privacy Policy.

How We Share Your Information

We may share your information with:

  • Service providers, meaning third-party vendors who perform services on our behalf, such as website hosting, analytics, email delivery, scheduling, and customer relationship management, only to the extent necessary for them to perform those services;
  • Advertising partners, such as Google, as described under Cookies and Tracking Technologies;
  • Legal and safety recipients, to comply with any court order, law, or legal process, including any government or regulatory request; to enforce our rights under any agreement between you and us; and when we believe disclosure is necessary or appropriate to protect the rights, property, or safety of CyNtell, our clients, or others; and
  • Successors, in connection with a business transfer, as described under Business Transfers.

Sale or "Sharing" of Personal Information

CyNtell does not sell personal information for money. Some state privacy laws define "sharing" broadly enough to include the use of advertising cookies for cross-context behavioral advertising, such as the Google Ads remarketing described above. To the extent our use of advertising cookies counts as "sharing" under applicable law, you may opt out as described under Cookies and Tracking Technologies and Your Privacy Rights by Region.

Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy, such as responding to your inquiry, maintaining business records, or complying with legal, accounting, or reporting obligations. After that, we securely delete or de-identify it, unless a longer retention period is required or permitted by law.

Data Security

We have implemented measures designed to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, no method of transmission over the internet is completely secure. Although we work to protect your personal information, we cannot guarantee the security of information transmitted to our Site, and any transmission is at your own risk.

If a security incident affects your personal information, we will notify affected individuals and any required regulators as required by applicable law.

International Data Transfers

CyNtell is based in the United States, and the personal information we collect is processed and stored primarily in the United States. Some of our service providers may also process information in other countries. If you are located outside the United States, information you provide will be transferred to and processed in the United States, which may have data protection laws different from, and potentially less protective than, those in your country. By using the Site, you understand that your information may be transferred to our facilities and to the third parties with whom we share it as described in this policy.

Your Privacy Rights by Region

Depending on where you live, you may have certain rights regarding your personal information. These rights are subject to exceptions and limitations under applicable law and may not apply in every case. To make a request, see Contact Us and How to Exercise Your Rights.

California Residents

If the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies to your information, you may have the right to:

  • Know what personal information we have collected about you, including the categories of information, sources, purposes, and recipients;
  • Request a copy of the specific personal information we hold about you;
  • Request that we correct inaccurate personal information;
  • Request that we delete personal information we have collected from you;
  • Opt out of the sale or sharing of your personal information; and
  • Not be discriminated against for exercising any of these rights.

You may use an authorized agent to submit a request on your behalf. We will respond to verified requests within the time required by law.

Maryland, Virginia, Colorado, Connecticut, and Other U.S. State Residents

If a comprehensive state privacy law applies to your information, you may have the right to:

  • Confirm whether we process your personal information and access it;
  • Correct inaccuracies in your personal information;
  • Delete your personal information;
  • Obtain a copy of your personal information in a portable format; and
  • Opt out of targeted advertising, the sale of personal information, and certain profiling.

If we decline your request, you may appeal by contacting us with "Privacy Appeal" in the subject line. If your appeal is denied, you may contact your state's Attorney General.

Nevada Residents

Nevada residents may submit a request directing us not to sell certain covered information. CyNtell does not sell covered information as defined by Nevada law, but you may still submit a request using the contact information below.

European Economic Area, UK, and Other International Visitors

If the General Data Protection Regulation (GDPR), UK GDPR, or a similar law applies to your information, you may have the right to:

  • Access, correct, or delete your personal information;
  • Restrict or object to our processing of your personal information;
  • Receive your personal information in a portable format;
  • Withdraw your consent at any time, where we rely on consent; and
  • Lodge a complaint with your local data protection authority.

Do Not Track and Global Privacy Control

Some browsers and browser extensions can send a "Do Not Track" (DNT) signal or a Global Privacy Control (GPC) opt-out preference signal to websites. Our Site does not currently respond to DNT or GPC signals. You can still opt out of advertising cookies as described under Cookies and Tracking Technologies.

Children's Privacy

Our Site is not intended for children under 13 years of age, or under 16 where a higher age threshold applies under state law, and we do not knowingly collect personal information from children under the applicable age. If we learn we have collected personal information from a child under that age, we will delete it as quickly as possible. If you believe we may have collected information from a child, please contact us using the information under Contact Us.

Job Applicants and the Careers Page

If you apply for a position with CyNtell through our Careers page or otherwise submit application materials, such as a resume or cover letter, we use that information to evaluate your candidacy and communicate with you about the position. Depending on the role, background screening may be required as part of our hiring process. If so, we will provide additional, role-specific notices at that time.

Business Transfers

If CyNtell is involved in a merger, acquisition, financing, reorganization, or sale of all or a portion of its assets, your information may be disclosed or transferred as part of that transaction. We will notify you, for example through a notice on the Site, of any change in ownership or uses of your personal information, as well as any choices you may have regarding your information.

Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the "Last updated" date at the top of this policy and, where appropriate, notify you through other means. We encourage you to review this policy periodically.
